Terms of Service

These Terms of Service (ToS) govern access to and use of the DPPify, available at dpp-platform.eu. By using the service, you accept these terms in their entirety.

1. Definitions

  • "Service"the DPPify SaaS application and all of its features
  • "User"any natural person holding an account on the platform
  • "Organization"the entity (company, association) on behalf of which the User uses the Service
  • "DPP"Digital Product Passport created through the Service
  • "Publisher"[TO BE COMPLETED — company name], operator of the platform

2. Purpose of the Service

DPPify enables Organizations to create, manage and publish Digital Product Passports compliant with the European ESPR regulation (Ecodesign for Sustainable Products Regulation — EU 2024/1781). The Service includes the generation of QR codes, public pages and UNTP credentials.

3. Registration and Account

3.1 Account Creation

Registration is free and open to any natural person acting on behalf of an Organization. The User undertakes to provide accurate information and to maintain the confidentiality of their login credentials.

3.2 Account Responsibility

The User is responsible for all activity carried out under their account. In the event of unauthorized access, the User must immediately notify the Publisher at contact@dpp-platform.eu.

4. Plans and Pricing

4.1 Available Plans

The Service offers several plans (Free, Starter, Pro, Custom) described on the Pricing page. The features and limits of each plan are detailed on that page.

4.2 Payment

Payments are processed by Lemon Squeezy LLC, acting as Merchant of Record. Displayed prices are exclusive of tax. VAT is automatically calculated and collected by Lemon Squeezy based on the User's location.

4.3 Renewal and Cancellation

Subscriptions are automatically renewed each month. The User may cancel at any time via the customer portal. Cancellation takes effect at the end of the current period. No pro-rata refund is provided.

4.4 Plan Changes

When downgrading to a lower plan, published DPPs exceeding the new limit will be locked in read-only mode. The User retains access to their data but will not be able to edit locked DPPs until they upgrade again or archive existing DPPs.

5. Data and Intellectual Property

5.1 User Data

The User retains ownership of all data entered into the Service (product information, files, compositions). The Publisher acquires no ownership rights over this data.

5.2 License of Use

The User grants the Publisher a limited, non-exclusive license to host, display and transmit their data for the sole purpose of providing the Service, including the publication of public DPP pages and the generation of credentials.

5.3 Public Pages

Published DPPs are publicly accessible via a URL and QR code. The User acknowledges that the information contained in a published DPP is visible to anyone with the link or who scans the QR code. The User is solely responsible for the accuracy of published information.

5.4 Service Ownership

The Service, its source code, design and brand remain the exclusive property of the Publisher. Nothing in these Terms grants the User any rights over these elements.

6. User Obligations

The User undertakes to:

  • Use the Service in accordance with its intended purpose and applicable laws
  • Not enter false or misleading information in DPPs
  • Not attempt to circumvent the technical limitations of the Service
  • Not use the Service for unlawful purposes or in a manner that infringes the rights of third parties
  • Respect third-party intellectual property rights in uploaded content

7. Availability and Maintenance

The Publisher endeavours to ensure the availability of the Service 24/7, but does not guarantee uninterrupted availability. Maintenance operations may cause temporary interruptions. The Publisher will inform Users where possible in the event of scheduled maintenance.

8. Limitation of Liability

The Service is provided "as is". The Publisher does not warrant that the Service will be free from errors or that generated DPPs will comply with all regulatory requirements specific to each product or sector.

The User remains solely responsible for the compliance of their products and the accuracy of the information entered. The Publisher shall not be held liable for any regulatory, financial or commercial consequences arising from the use of the Service.

The Publisher's total liability is limited to the amounts paid by the User during the 12 months preceding the event giving rise to liability.

9. Termination

The Publisher reserves the right to suspend or terminate a User's account in the event of a breach of these Terms, fraudulent use of the Service, or non-payment. The User will be notified by email and will be given a reasonable period to remedy the situation.

In the event of termination, the User may export their data (JSON, CSV) for a period of 30 days. After this period, the data will be deleted.

10. Changes to the Terms

The Publisher reserves the right to modify these Terms. Changes will be notified by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.

11. Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties will endeavour to reach an amicable solution. Failing that, the competent courts of [TO BE COMPLETED — city of registered office] shall have sole jurisdiction.
